for the DJReport software

§1 Provider

§2 Subject Matter

(1) DJReport is locally operating software for creating music playlists based on export files from DJ software.

(2) Supported file formats include those from Rekordbox and Serato DJ in particular.

(3) The software generates reports based on the requirements of collecting societies, in particular GEMA, as known at the time of use. No guarantee is given that individual reports will be recognised or have legal effect.

§3 Independence / Trademark Notice

DJReport is an independent product. There is no commercial or organisational connection to Rekordbox, Serato DJ, or GEMA. These names are mentioned solely to describe technical compatibility.

§4 Contract Conclusion / Apple

Purchases are made through the Apple App Store. Apple is not a contractual party with respect to the use of the software. Billing, management, and cancellation of subscriptions are handled exclusively through Apple.

§5 Data Backup Obligation

The user is obliged to create adequate backup copies of their databases, music libraries, and project files before using the software.

§6 Liability

(1) Unlimited Liability

The provider is liable in cases of intent, gross negligence, injury to life, body, or health, and for claims under the Product Liability Act.

(2) Minor Negligence

In cases of minor negligent breach of material contractual obligations, liability is limited to the foreseeable, contract-typical damage.

(3) Data Loss

In the event of data loss, the provider's liability is limited to the cost of recovery that would have been incurred with proper data backup in place.

(4) Indirect Damages

To the extent permitted by law, liability for indirect damages is excluded, including in particular lost profits, cancelled events or tours, contractual penalties, and reputational damage.

(5) Third-Party Software

No liability is accepted for damages caused solely by changes to file formats, updates, or system adjustments by third-party software, or by faulty export files.

§7 Warranty

Statutory warranty rights for digital products apply. Permanent compatibility with future versions of third-party software is not guaranteed.

§8 Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions remain unaffected.
